These Terms of Service ("Terms") govern your use of the website vistosocreative.com and the social media scheduling tool at postiz.vistosocreative.com, both operated by Vistoso Creative, LLC ("Vistoso Creative," "we," "us," or "our"). By using the website or the scheduling tool, you agree to these Terms. If you do not agree, please do not use them.
1. Who We Are
Vistoso Creative, LLC is based in Staunton, Virginia. We design and build websites and brands for small businesses and nonprofits, and provide related services such as website hosting and social media management. You can reach us at hello@vistosocreative.com.
2. Using Our Website
You may browse our website, read our content, and download our free resources for your own personal or internal business use.
The content on our website, including blog posts, guides, and tools such as our Ad Spend Calculator, is general information. It is not professional, legal, financial, or marketing advice for your specific situation. Figures produced by our tools are estimates, not quotes or guarantees.
When you submit a form on our website, you agree to provide accurate information. How we handle that information is described in our Privacy Policy.
3. Our Services
Our design, development, branding, hosting, and social media management services are provided under a separate written agreement, proposal, or statement of work with each client (a "Client Agreement"). These Terms apply to your use of our website and our scheduling tool. If anything in these Terms conflicts with a Client Agreement, the Client Agreement controls.
Service descriptions and prices shown on our website are for information only. They become a commitment only when confirmed in a Client Agreement.
4. Social Media Scheduling Tool
Vistoso Creative operates a self-hosted social media scheduling tool, built on the open-source Postiz platform, at postiz.vistosocreative.com (the "Scheduling Tool"). We use it to create, schedule, and publish posts, and to review how those posts perform, on social media accounts we manage: our own and those of our clients. The Scheduling Tool is not a public sign-up service; access is limited to Vistoso Creative and the clients whose accounts we manage.
The Scheduling Tool can connect to accounts on platforms including TikTok, Instagram, Facebook, Threads, LinkedIn, Google Business Profile, and Slack.
Connecting accounts.
A social media account is connected to the Scheduling Tool only by the account's owner, or by us with the owner's authorization, through that platform's official OAuth login and consent flow. We never ask for or store your social media passwords. The Scheduling Tool acts on a connected account only within the permissions granted on the platform's consent screen.
Your content and approvals.
You are responsible for the content you provide to us or approve for publishing, including making sure you have the rights to any text, images, video, and music it contains, and that it is accurate and lawful. We publish to a connected account only on a schedule that the account owner or their team has approved.
Each platform's own terms apply.
Every connected account remains subject to its platform's own terms, policies, and community guidelines, and anyone using the Scheduling Tool with that account must follow them. These include:
- TikTok: TikTok Terms of Service
- Meta: Facebook Terms of Service, Instagram Terms of Use, and Threads Terms of Use
- LinkedIn: LinkedIn User Agreement
- Google: Google Terms of Service and Google Business Profile policies
- Slack: Slack User Terms of Service
Platforms may change their features, APIs, and limits at any time. We are not responsible for actions a platform takes, such as rejecting or removing a post, limiting its reach, or restricting an account.
Revoking access.
You can revoke the Scheduling Tool's access to your account at any time, either from the platform's own settings (for example, TikTok's Manage app permissions, Facebook Settings → Business Integrations, or your Google Account permissions) or by emailing us at hello@vistosocreative.com. Once access is revoked, the Scheduling Tool can no longer post to or read from that account, and the stored access tokens are deleted as described in Section 5 of our Privacy Policy.
No affiliation.
The Scheduling Tool is operated independently by Vistoso Creative. It is not affiliated with, endorsed by, or sponsored by TikTok, Meta, LinkedIn, Google, Slack, or any other platform it connects to. Platform names and logos are trademarks of their respective owners.
5. Acceptable Use
When using our website or the Scheduling Tool, you agree not to:
- Use them for any unlawful purpose
- Publish content that infringes anyone's intellectual property or privacy rights, or that is unlawful, deceptive, harassing, or hateful
- Violate any connected platform's terms, policies, or community guidelines
- Send spam, generate fake engagement, or otherwise manipulate platform features or metrics
- Access, or attempt to access, any account, system, or data you are not authorized to use
- Interfere with the security or operation of our website or the Scheduling Tool, including by introducing malware or placing an unreasonable load on our systems
We may remove content or suspend access that violates these Terms.
6. Intellectual Property
The content of our website, including its text, graphics, logos, and design, is owned by Vistoso Creative, LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or distribute it beyond the personal use described in Section 2 without our written permission.
Content you provide to us remains yours. You give us a limited permission to host, copy, format, and publish it as needed to provide our services and to operate the Scheduling Tool on your behalf. Ownership of work we create for a client is governed by that client's Client Agreement.
The Scheduling Tool is built on Postiz, open-source software distributed under its own license. Nothing in these Terms limits any rights you have under that license.
7. Third-Party Links and Services
Our website and the Scheduling Tool link to, or work with, websites and services run by other companies, including the social media platforms listed in Section 4. We are not responsible for their content, policies, or availability, and your use of them is governed by their own terms.
8. Disclaimers
Our website and the Scheduling Tool are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that our website or the Scheduling Tool will be uninterrupted or error-free, or that a scheduled post will publish at an exact time or at all, since platforms can delay, reject, or remove posts. We do not guarantee any particular marketing result, such as traffic, search rankings, followers, engagement, or sales.
9. Limitation of Liability
To the fullest extent permitted by law, Vistoso Creative, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of our website or the Scheduling Tool.
To the fullest extent permitted by law, our total liability for any claim arising from these Terms or your use of our website or the Scheduling Tool will not exceed the greater of (a) the amount you paid us for the specific service giving rise to the claim in the 12 months before the claim, or (b) $100. Liability for services provided under a Client Agreement is governed by that agreement.
10. Indemnification
You agree to indemnify and hold harmless Vistoso Creative, LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, content you provide or approve for publishing, or your violation of any law or the rights of a third party, including a platform's terms.
11. Termination
We may suspend or end your access to our website or the Scheduling Tool at any time if you violate these Terms, if it is needed to protect the Scheduling Tool, our clients, or connected accounts, or when our engagement with you ends. You may stop using them at any time and disconnect your accounts as described in Section 4. Ending client services is governed by the Client Agreement.
Sections 6 through 10 and Section 12 continue to apply after your access ends.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Unless a Client Agreement says otherwise, any dispute arising from these Terms will be resolved in the state or federal courts located in Virginia, and you consent to their jurisdiction.
13. Privacy
Our Privacy Policy explains how we collect, use, and protect information, including data from social media accounts connected to the Scheduling Tool.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. If you keep using our website or the Scheduling Tool after an update, you accept the updated Terms. We encourage you to review these Terms periodically.
15. General
These Terms, together with our Privacy Policy and any Client Agreement, are the entire agreement between you and Vistoso Creative, LLC about their subject. If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of our right to enforce it later.
